Jack O'Kelley Sertoma Club

ELIGIBILITY
You must be 21 years or older to purchase a raffle entry. Online one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Entries may be purchased via the Internet (Paypal.com) by making payment to jokelly_sertoma@yahoo.com. Tickets can be purchased by mail at: Jack O'Kelley Sertoma Club, PO Box 711, Burlington, NC 27215. Tickets can also be purchased from members of Jack O'Kelley Sertoma Club or their agents. Ticket confirmation number(s) will be emailed to Internet purchasers upon order. Raffle tickets are non-transferable and non-refundable; all tickets sales are final. The members of Jack O'Kelley Sertoma Club and their immediate family are ineligible to purchase tickets. Immediate family is defined as family members residing in the same household as the Jack O'Kelley Sertoma member.

INTERNET PURCHASES
This car raffle will be posted on the internet at www.dreamcarraffles.com and www.oldcarraffle.com. It is the purchaser's responsibility to provide a valid email and US Postal mailing address and contact information in order to successfully receive the email ticket confirmation and to remove any system blocks that would prevent the successful delivery of the email confirmation. Confirmation information may be mailed to entrant upon request. Jack O'Kelley Sertoma Club and its agents, Board, or members assume no liability for lost, late, misdirected, mutilated, illegible, undelivered entries. Entries without proper payment received will be deemed invalid and shall be immediately disqualified.

DRAWINGS
A maximum of 800 entries will be sold for this raffle. Ticket prices are 1 for $50 or 5 for $200. The Grand Prize Draw Date is Saturday, August 11 at 12:00noon (EST). Drawing will be conducted at Dick Shirley Chevrolet, 2616 Alamance Rd., Burlington, NC. Tickets can be purchased from members until 11:00 am. (EST) August 11, 2007. Internet sales end at 11:59pm August 10, 2007.

ODDS
Only 800 tickets will be sold. The chances of winning are based upon that number. If fewer tickets are sold, then the odds improve. If fewer than 350 tickets are sold, the Grand Prize drawing will be for one half of the total collected entry fees less expenses, payable by check to the winner (50/50 pot). The vehicle will not be awarded in that event.

GRAND PRIZE
The Grand Prize in this raffle is a 2007 Chevrolet HHR. The Grand Prize winner may choose to accept an alternate cash prize of $10,000 (tax paid) instead of the car. ($10,000 is maximum cash prize allowed by NC State law). Proceeds from the raffle will be used to purchase the vehicle from Dick Shirley Chevrolet. Winner of the 2007 Chevrolet must arrange pick-up of the vehicle from Dick Shirley Chevrolet

CONTINGENCY
If fewer than 350 tickets are sold, the Grand Prize drawing will be for one half of the total collected entries less expenses, payable by check to the winner (50/50 pot). The vehicle will not be awarded in that event.

NOTIFICATION OF WINNERS
Winner need not be present to win. Winner will be notified in writing via Registered Mail of requisite procedure to claim prize. Winner's name will be posted at www.dreamcarraffles.com and www.oldcarraffle.com within 5 calendar days of the drawing. Winning entrant is required to inform Jack O'Kelley Sertoma Club within seven (7) calendar days from notification of their choice to take possession of the Dream Car or accept cash, however, winners may have up to fourteen (14) calendar days of draw date to finalize the process (including payment of taxes, withholding, etc). Winning entrants' name and location by city or town and photo will be printed in select media of Jack O'Kelley Sertoma Club. If selected winning entrant is unable to be contacted or located after a period of one (1) month from the draw date, the prize will be donated to the Jack O'Kelley Sertoma Club. Three (3) attempts will be made to contact the winning entrant via Registered Mail at the address provided by the entry purchaser and via email and phone as provided.

TAXES AND IRS RULES
Winner is responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. Vehicle winner will be responsible for any and all state or local tax, license, title and registration fees associated with the vehicle. Winner will be responsible for any or all delivery fees and/or are responsible for retrieval of their prize. Winner will be required to pay a withholding percentage (29%) of the fair market value of the vehicle or cash prize prior to taking possession of the prize, to comply with IRS for Federal and State withholding requirements. If winner opts for $10,000 cash, payment to winner will be full $10,000 with taxes paid by Jack O'Kelley Sertoma Club. This is to comply with the IRS ruling that requires that tax withholding on prizes of $5000 or greater must be paid upon award and distribution by the organization hosting the raffle. The value of your winnings is considered taxable income. Please consult your financial advisor to discuss any impact on your personal taxable income. The IRS has taken the position that amounts paid for chances to participate in lotteries, raffles, or similar programs are not gifts and therefore, the price of entry does not qualify as a deductible charitable contribution. Government rules regarding withholding can change without notice. The Jack O'Kelley Sertoma Club Raffle will follow IRS rules in effect at the time the prizes are awarded.

WAIVER/LIMITATIONS OF LIABILITY
Entrants, by participating (and winners accepting a prize) release the Jack O'Kelley Sertoma Club, officers, partners, and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded. Entrants will not hold the Jack O'Kelley Sertoma Club responsible or liable for any or all accidents, theft or damages resulting by their participation in this event.

RELEASE
Entrants, by participating, agree to allow Jack O'Kelley Sertoma Club to use their names, photos and statements in promotional material. The Jack O'Kelley Sertoma Club will not share other personal information from entries with other organizations.
